Northwest Territories drone laws: no parks rule, a new trespass act, and Yellowknife's airspace

The short version

The Northwest Territories has no drone rule in its parks legislation at all — I read the Act and both sets of regulations, and none mentions aircraft, drones, UAVs or model aircraft. What a commercial operator needs is a park use permit for the commercial activity, not a drone permit. NWT has just acquired its first trespass statute — the Trespass to Property Act received assent on 6 March 2026. And Yellowknife’s much-cited drone page is not a bylaw.

Territorial parks: a genuine absence

This is a real regulatory gap rather than a failure to find something, so it is worth setting out what I checked:

  • Territorial Parks Act, R.S.N.W.T. 1988, c.T-4 — no mention of aircraft or drones. It regulates motor vehicles, park use permits (s.8(1)–(2)) and the Commissioner’s regulation-making power (s.15). s.14(1) sets penalties: first offence a fine not exceeding $500 or 30 days, or both; subsequent offence not exceeding $1,000 or six months, or both.
  • Territorial Parks Regulations (RRNWT 1990, c.T-13) — no mention of aircraft, drones, UAVs, RPAS or model aircraft. Covers camping, commercial use, vehicle entrance permits, ATVs and fire.
  • Recreation Parks and Heritage Parks Regulations (R-025-2003) — designation and boundaries only, no drone provision.
  • The NWT Parks public rules page contains no mention of drones, UAVs, RPAS or aircraft.

The most recent parks regulatory amendment exercise, led by Industry, Tourism and Investment and closed in September 2022, covered special events, ATV licensing and minimum camping age. Drones were not among the amendments.

So do not say that NWT parks ban drones — that is not supported. What applies is: full CARs Part IX compliance, plus, for commercial work, a park use permit under s.8(1) issued by the Superintendent for the commercial activity itself. Industry, Tourism and Investment administers territorial parks — parks@gov.nt.ca, 867-767-9206.

The NWT Film Commission frames it the same way: drone requirements are Transport Canada’s — pilot certificate, registration and marking — and no additional NWT departmental drone permit is listed.

A commercial licensing catch. The NWT Tourism Regulations s.20 provides that a person shall not advertise or represent to others that they are a tourism operator unless they hold a tourism operator licence, and s.12(1) ties activities to the licensed area of operation. Whether an aerial-content business is a “tourism operator” depends on whether you guide or serve clients in the field. If your NWT work looks anything like guided or outfitted activity, check this before you advertise.

Trespass: brand new

Until recently the Northwest Territories had no act governing trespassing on private property — the GNWT Justice FAQ said so explicitly as of September 2025, noting that lawful occupiers had limited tools to remove trespassers and that legislation was being developed on an accelerated schedule.

That has now changed. Bill 34, the Trespass to Property Act, passed third reading and received assent on 6 March 2026 in the Legislative Assembly of the Northwest Territories. The Assembly’s bill page does not state a separate coming-into-force date, so before relying on any specific offence or penalty, confirm whether the Act — and any regulations under it — are actually in force. This is the newest piece of law on this page and the one most likely to have moved since I wrote it.

The practical guidance does not change either way: get permission for your launch point, in writing where money is involved.

Privacy

The NWT Access to Information and Protection of Privacy Act (SNWT 1994, c.20) applies to GNWT public bodies — departments, branches, offices, agencies, boards and commissions — administered by the Access and Privacy Office. It does not apply to private businesses.

PIPEDA applies by default to commercial drone imaging. The federal Privacy Commissioner’s position is that PIPEDA applies to organizations in the Northwest Territories, Yukon and Nunavut, as they are considered federally regulated. There is no territorial carve-out.

Yellowknife: read the page carefully

Yellowknife is the only northern capital with a dedicated drone page, and it is frequently cited as though it were a bylaw. It is not.

The page’s only stated requirement is federal: users of UAVs above 250 grams within City limits are required by law to obtain an Advanced Operations pilot certificate. It then describes the City’s own pre-flight process for municipal operations — filing a NOTAM and obtaining NAV CANADA approval. No City bylaw number, no municipal permit, and no municipal penalty is published.

The Advanced requirement is not a municipal invention — it follows from geography. Yellowknife sits entirely inside controlled airspace, so any operation in the city is automatically an advanced environment. Local reporting puts the boundary at the Ingraham Trail beyond the Dettah turn-off, where uncontrolled airspace begins. If you are flying in Yellowknife, you need Advanced certification and a NAV CANADA RPAS Flight Authorization — not because of a bylaw, but because of the airspace.

Wildfire

The GNWT Environment and Climate Change airspace restrictions page is a good, plain-language citation for the federal rule: under CARs s.601.15, no unauthorized person may operate an aircraft over a forest fire area, or within five nautical miles of one, at an altitude below 3,000 feet AGL — and NOTAMs may further expand or restrict airspace under s.601.16. Operating in fire-restricted airspace compromises aviation safety; report incidents to police or a Transport Canada Civil Aviation office. No GNWT-specific fine amount is published, so the exposure is the federal one — up to $3,000 for an individual and $15,000 for a corporation.

Flying in the North: the operational reality

These points apply across all three territories and are worth more to a working pilot than any of the legal detail above.

Everything is in degrees true, and your compass is not reliable

Northern Domestic Airspace is referenced to true north, not magnetic. NAV CANADA’s Aeronautical Information Circular 005/2026, published 2 April 2026, consolidates the operating procedures and states that magnetic variation “can be large and change relatively rapidly over short distances,” that “magnetic compasses can be erratic within regions of NDA,” that runway headings are published in degrees true, that all airports are referenced to True North, and that all ground-based navigation aids are aligned to True North with 0° declination. NAV CANADA separately identifies 21 aerodromes with instrument approaches inside the area of compass unreliability.

Why this matters specifically for drones: a consumer aircraft derives its heading from a magnetometer. In an area of compass unreliability, failed calibrations, yaw errors and “compass interference” aborts are expected behaviour, not a defective airframe. Plan for it: calibrate on site, expect to repeat it, prefer RTK or multi-GNSS heading where your aircraft supports it, and be aware that your ground station’s map bearings — usually magnetic — will not match published aerodrome headings, which are true.

Sparse aerodromes, but you are closer to one than you think

Yukon has 28 facilities — five certified airports plus 23 community aerodromes and airstrips. The Northwest Territories operates 27 airports. Nunavut has 25, and no road connections between communities. The consequence is counter-intuitive: a drone flown “in the middle of nowhere” near a northern hamlet is very likely near an aerodrome and under a low-level medevac or resupply track. Settlements and airstrips are co-located out of necessity, so the 5.6 km (3 NM) certified-airport and 1.9 km (1 NM) heliport distances bite constantly in the North.

NAV Drone works, but fewer operations trigger an authorization

The tool is the same nationally — NAV Drone, mobile and at portal.navdrone.ca, with geozone layers for controlled airspace, certified aerodromes, military installations, restricted airspace, parks and NOTAMs. I found no NAV CANADA statement that northern coverage differs from southern coverage, and I am not going to claim it does.

The honest framing: the request mechanism is identical, but because northern controlled airspace is sparser and many northern aerodromes are uncontrolled or registered rather than certified and towered, far fewer northern operations trigger a NAV CANADA authorization in the first place. The residual risk shifts from “get a clearance” to “self-deconflict with low-level traffic no tool is showing you.” Yellowknife is the counter-example and worth calling out — the entire city sits in controlled airspace.

Cold, distance and no same-day remedy

Battery capacity falls sharply in deep cold; check your manufacturer’s published operating-temperature specification rather than any rule of thumb. More consequential is the support picture: no local parts, no local warranty service, freight lead times measured in days or weeks, and fuel and generator logistics for charging. A failed compass calibration or a lost aircraft has no same-day fix. Northern work is planned around redundancy, not around recovery.

The flight review is the northern bottleneck, not the exam

The Basic and Advanced knowledge tests are written online through Transport Canada’s Drone Management Portal and are therefore equally accessible from anywhere with a connection — the North is not disadvantaged on the exam at all. The flight review is the constraint, because it must be conducted in person, and Transport Canada publishes a flight school list rather than a reviewer directory.

There were 1,357 flight reviewers in Canada as of 10 June 2026, and very few of them are northern. Yukon has at least one intermittent local pathway through Yukon University’s RPAS advanced pilot course, which includes a Transport Canada flight review — though it showed no upcoming sessions scheduled when I checked. For the Northwest Territories and Nunavut I could not confirm any resident reviewer. Candidates there generally either bring a reviewer north or time the review around southern travel.

Your certificate is national. The Advanced written exam is 50 questions in 60 minutes at an 80% pass mark, written online from anywhere in Canada, and it is worth exactly the same here as in Toronto.
